The following chart lists state legislation enacted between July 1 - July 31, 2019. While not an exhaustive list of all new state laws, this chart provides Alliance members with information on the new legislation that may impact the operations of fraternal life insurers. These laws may result in new compliance requirements for your society, so we encourage you to review the list carefully and pay close attention to the laws enacted in the states in which you do business.

As several states are starting to pre-file bills for 2020, the Alliance will be reviewing them for any impact on fraternals.

Enacts the NAIC Insurance Data Model Security Act (MDL 668). Establishes standards for data security for Title 18 licensees and standards for the investigation of and notification to the Commissioner of a cybersecurity event affecting Title 18 licensees.

Life Insurance Claims

Amends Del. Code Ann. Section 2914 relating to required provisions relating to payment of claims by a life insurer: (1) Specifies that a certified copy of an insured's death certificate, or other lawful evidence providing equivalent information, is acceptable as due proof of death; and (2) Requires that interest be paid on the death benefit due under a life insurance policy.

Insurance Notices

Amends Hawaii revised Statute Section 431:3A-202 to provide an exception to the requirement that an insurer provide annual privacy notices to all its customers. An insurer is exempt from the annual privacy notice requirement if: (1) The insurer provides nonpublic personal financial information to nonaffiliated third parties under certain conditions where the notice, opt out, or service providers and joint marketing provisions do not apply; and (2) The insurer's policies and practices relating to disclosure of nonpublic personal information remain unchanged.

Insurance Company Voluntary Payments

Among other matters, amends Mo. Rev. Stat. Section 374.191 to provide that if an insurance company voluntarily pays interest on any claims, refunds, penalties, or payments in which the interest rate is not provided by law, the interest factor used will be as determined by section Mo. Rev. Stat. Sec 32.065 but will not exceed 9% per annum.

Among other matters, amends N. C. Gen. Stat. Section 58-39-26 relating to the required annual privacy notice that insurers must provide to policyholders. Amendments would cause it to conform to the current NAIC model language.
